Sec 11362.5(a) of the Health and Safety Code is also known as the Compassionate Use of Act of 1996 and it allows the seriously ill in California to obtain and use marijuana for medical purposes.
As a requirement, the medical use must be deemed appropriate and recommended by a physician who has determined that the individual’s health would benefit from the use of the marijuana in the treatment of cancer, anorexia, AIDS, chronic pain, spasticity, glaucoma, arthritis, migraine or any other illness.
Individual caregivers who obtain and use marijuana for their patients under physician’s recommendations are exempt from criminal prosecution or sanction.
